European Commission suspends additional customs duties on certain US-origin products

EU customs must cease applying the additional duties on covered US-origin products from 11 July 2026; importers of those products stop incurring the extra duty

Change
On 6 July 2026 the European Commission adopted Implementing Regulation (EU) 2026/1549 suspending the application of Implementing Regulation (EU) 2020/1646 (which imposed additional customs duties on certain products originating in the United States in connection with the WTO large civil aircraft disputes); the suspension enters into force on 11 July 2026 and is binding and directly applicable in all Member States.
Why it matters
While the suspension is in force, the legal basis for imposing the additional duties under Implementing Regulation (EU) 2020/1646 is inactive, so importers of the covered US-origin products no longer incur those additional duties from 11 July 2026. The suspension continues the mutual-suspension arrangement with the United States and the Commission will keep it under review under Article 7(3) of Regulation (EU) No 654/2014, meaning the duties could be reactivated if circumstances change.
Implications
  • Customs authorities in EU Member States must stop applying the additional customs duties set out in Implementing Regulation (EU) 2020/1646 from 11 July 2026; continuing to apply those duties after that date would contravene the binding EU Regulation.
  • National customs tariff configuration and operations teams must remove or disable tariff rules and automated duty-application settings tied to Implementing Regulation (EU) 2020/1646 by 11 July 2026 to align assessments with the suspension; failing to update systems risks incorrect duty collection.
  • Importers and customs brokers bringing the covered US-origin products into the EU should update landed-cost calculations and duty accruals to reflect that the additional duties do not apply from 11 July 2026, while noting the Commission may reactivate the measures if the underlying arrangement with the United States changes.
Who is affected
  • Customs authorities in EU Member States
  • National customs tariff configuration and operations teams
  • Importers and customs brokers handling the covered US-origin products
What to watch
  • Effective: 11 July 2026 — Implementing Regulation (EU) 2026/1549 enters into force and the application of Implementing Regulation (EU) 2020/1646 is suspended.
  • Under review: the Commission may take further action under Article 7(3) of Regulation (EU) No 654/2014 if trade relations with the United States change, which could reactivate the additional duties.
